The General Maritime Law of the United States applies to accidents occurring on the navigable waterways, to the exclusion of the laws of any State. For instance, even though State laws may have limits or caps on the amount of damages that can be awarded in lawsuits, the general maritime law has no such limitations. Lawsuits under the general maritime law can be brought in either federal or State court, and we generally choose the one that would be most advantageous under the circumstances.





There are some federal statutes that may apply in certain cases which could pose a trap for a lawyer not familiar with them. Among them is the Limitation Of Liability Statute which can limit the amount of damages awarded to the value of the vessel involved in an accident unless it can be shown that the owner knew of the negligent condition or conduct. This is a tricky and complicated law that could easily sink a case if the lawyer handling it is unaware of the maritime law. Fear not, WE ARE AWARE.
